Terminology and Definitions
Cookies and similar technologies
The LSSI applies to cookies as understood at the beginning of this guide, that is, any type of data storage and retrieval device used on a user’s terminal equipment for the purpose of storing information and retrieving already stored information, as established in Article 22.2 of the LSSI.
Cookies allow the storage of data on the user’s device, ranging from a few kilobytes to several megabytes.
Below, cookies are classified according to several categories.
It should be noted that the same cookie may be included in more than one category.
2.1.1. Types of cookies according to the entity that manages them
Depending on who manages the device or domain from which the cookies are sent and processes the data obtained, we can distinguish:
a) First-party cookies: those sent to the user’s device from a device or domain managed by the editor itself and from which the requested service is provided to the user.
b) Third-party cookies: those sent to the user’s device from a device or domain not managed by the editor, but by another entity that processes the data obtained through the cookies.
If the cookies are served from a device or domain managed by the editor but the information collected is managed by a third party, they cannot be considered first-party cookies if the third party uses them for its own purposes (for example, improving the services it provides or offering advertising services to other entities).
2.1.2. Types of cookies according to their purpose
There are many purposes for using cookies. Depending on the purpose for which the data obtained through cookies are processed, some of them may include:
a) Technical cookies: these allow the user to navigate through a website, platform, or application and use the different options or services available, including those used by the editor to manage and operate the website and enable its functions and services, such as controlling traffic and data communication, identifying the session, accessing restricted areas, remembering the items of an order, completing the purchasing process, managing payment, controlling fraud related to service security, submitting an application or participating in an event, counting visits for software license billing purposes, using security elements while browsing, storing content for video or audio streaming, enabling dynamic content (e.g., loading animations of text or images), or sharing content via social media.
Also included in this category, by their technical nature, are cookies that allow the most efficient possible management of advertising spaces that the editor has included in a website, application, or platform as part of its design or “layout,” based on criteria such as published content, without collecting information from users for other purposes such as customizing advertising or content.
Technical cookies are exempt from the obligations set out in Article 22.2 of the LSSI when they are used to provide the service requested by the user, as in the cases listed above. However, if they are also used for non-exempt purposes (e.g., behavioral advertising), they will be subject to such obligations.
b) Preference or customization cookies: these store information to allow the user to access the service with predefined general characteristics, such as language, number of results to display when performing a search, appearance or content of the service depending on the type of browser or region of access, etc.
If it is the user who chooses those characteristics (e.g., selecting the website language by clicking on a country flag icon), such cookies will be exempt from Article 22.2 of the LSSI, as they are considered an expressly requested service, provided the cookies are used exclusively for that purpose.
c) Analytics or measurement cookies: these allow their owner to monitor and analyze the behavior of users on linked websites, including quantifying ad impacts. The information collected is used to measure activity on websites, applications, or platforms, to introduce improvements based on user data analysis.
Regarding data collected through analytics cookies, the WP29 group stated that although they are not exempt from informed consent, they are unlikely to pose a risk to users’ privacy if they are first-party cookies, used with aggregated data for strictly statistical purposes, with transparent information about their use, and with opt-out options available to users.
d) Behavioral advertising cookies: these store information about users’ browsing behavior obtained through continuous observation of their browsing habits, enabling the development of a specific profile to display advertising based on that profile.
These categories are provided for guidance, as they are the most common. Editors and third parties may categorize cookies according to the purposes that best fit their use, as long as transparency toward users is maintained.
2.1.3. Types of cookies according to duration
Depending on how long they remain active on the user’s device, we can distinguish:
a) Session cookies: designed to collect and store data while the user accesses a website. They are typically used to store information relevant only to provide the service on a single occasion (e.g., a list of purchased products) and disappear at the end of the session.
b) Persistent cookies: data remain stored on the device and can be accessed and processed for a period defined by the cookie’s owner, ranging from minutes to years. It should be assessed whether persistent cookies are necessary, since privacy risks can be reduced by using session cookies. In any case, if persistent cookies are installed, their duration should be minimized depending on their intended use.
The WP29 Opinion 4/2012 indicated that for a cookie to be exempt from consent, its expiration must be related to its purpose. Thus, session cookies are more likely to be exempt than persistent ones.
